This page tells you the terms of use under which you may make use of my website www.phonicsplay.co.uk whether as a guest or as a subscriber. By using this site you indicate that you accept these terms and conditions. If you do not agree to these terms and conditions of use, then please refrain from using this site.

1) INFORMATION ABOUT US

www.phonicsplay.co.uk is a website owned and operated by Rosanna Springham. I am not registered for VAT.

2. INTELLECTUAL PROPERTY RIGHTS

2.1 I am the owner of all intellectual property rights in my site, and in the material published on it. Those works are protected by copyright law. All such rights are reserved.

2.2 You may print off copies and download extracts, of any page(s) on the website to use for educational purposes.

2.3 You must not use any part of the materials on my site for commercial purposes.

3. ACCESS

3.1 You are responsible for making all arrangements necessary for you to have access to my site. You are responsible for providing and maintaining suitable computer hardware, software and telecommunications equipment and services to enable you to access the site.

3.2 Access to free areas of the website is permitted on a temporary basis, and I reserve the right to withdraw or amend the service I provide on my site without notice. I will not be liable if for any reason the free site is unavailable at any time or for any period.

3.3 It is technically impractical to provide a fault free service and I do not undertake to do so. I will however make every reasonable effort to repair any reported faults as soon as is possible.

3.4 Occasionally it may be necessary to temporarily suspend the website for reasons such as: repair, maintenance or improvement of the service. Where reasonably practicable, I will give prior online notice of such a suspension and I will restore the service as soon as I reasonably can.

4. SECURITY

4.1 In order to access the 'subscription only' areas of the website, subscribers will be issued a login and unique password. You are responsible for the security and proper use of logins and passwords. You must take all necessary steps to ensure that they are kept confidential, used properly and not disclosed to unauthorised people.

4.2 You must immediately inform me if there is any reason to believe that a login or password has or is likely to become known to someone not authorised to use it or is being used in an unauthorised way.

4.3 Different levels of subscription indicate clearly the number of users that may make use of a given login and password. It is your responsibility that this number is never exceeded.

4.4 I reserve the right to disable a login or password at any time if, in my opinion, you have failed to comply with these terms.

5. INFORMATION ABOUT YOU

Any information that is collected about you will be processed in accordance with my privacy policy. By using my site, you consent to such processing and you warrant that all data provided by you is accurate.

6. MY LIABILITY

6.1 I aim to provide material which is as accurate as possible. However, the material displayed on my site is provided without any guarantees, conditions or warranties as to its accuracy.

6.2 By using this site, you accept that you are doing so at your own risk and that I may not be held responsible for any losses either direct or consequential.

6.3 I am not liable for the acts or omissions of other providers of telecommunications or Internet services or for faults in or failures of their equipment.

7. PAYMENTS AND CANCELLATION

7.1 All subscriptions will be pre-paid yearly.

7.2 Following the purchase of a subscription you have a seven day cooling off period during which you may cancel the subscription and receive a full refund. In order to cancel the subscription, please contact us by e-mail at customerservice@phonicsplay.co.uk

7.3 At any point during your membership you may cancel the membership by contacting us by e-mail at customerservice@phonicsplay.co.uk. However, after the seven day cooling off period, members who have pre-paid for a yearly membership will not be given a refund for the unused portion of their membership.

7.4 I reserve the right to change the amount of, or basis for determining any fees or charges. Any changes to fees will be introduced when the new fees are published on the website.

7.5 All online payments are processed through PayPal, which securely handles all transactions and doesn't share your credit card or banking information with us. You do not need a PayPal account to make a payment. If you have any queries relating to your transaction please contact PayPal.

7.6 Offline payments (by cheque) will only be accepted for Whole School Subscriptions by UK schools and must be accompanied by a completed order form. Subscriptions will be created and activated when both the cheque and order form are received by post. Unfortunately, items sent by post are sometimes subject to delay and may even become lost in the post. We cannot be held accountable should either of these occur. Please contact us at customerservice@phonicsplay.co.uk if you are concerned that your payment has not been received.

7.7 If a cheque is returned by your bank, your subscription will be suspended. You will be contacted as soon as possible to inform you that this has taken place. Your subscription will only be reinstated when full payment has been received and been cleared.

7.8 All transactions in the Phonics Play Shop are handled entirely by Amazon.co.uk.

7.9 All online payments and refunds are subject to the terms and conditions published on the PayPal website.

8. VARIATIONS

I may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes I make, as they are binding on you. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on my site.

9. VIRUSES, HACKING AND OTHER OFFENCES

9.1 You must not misuse my site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to my site, the server on which my site is stored or any server, computer or database connected to my site.

9.2 By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. I will report any such breach to the relevant law enforcement authorities and I will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use my site will cease immediately.

9.3 I cannot warrant that this site; information, content, materials (including software) or services included on or otherwise made available through this site; or e-mail sent from addresses ending @phonicsplay.co.uk are free from viruses or other harmful components.

9.4 I will not be liable for any loss or damage caused by viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of my site or to your downloading of any material posted on it, or on any website linked to it.

The Website may include links to other Internet sites solely as a convenience to users. I do not endorse any such sites or the information, material, products or services contained on or accessible through such sites, and You make use of such sites, including information, material, products and services therein, solely at your own risk.

11.1 You may link to any free page on my site, provided you do so in a way that is fair and legal and does not damage my reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on my part where none exists.
